The man on the Clapham omnibus is a hypothetical ordinary and reasonable person, used by the courts in English law where it is necessary to decide whether a party has acted as a reasonable person would – for example, in a civil action for negligence. The man on the Clapham omnibus is a reasonably educated and intelligent but nondescript person, against whom the defendant’s conduct can be measured.
The term was introduced into English law during the Victorian era, and is still an important concept in British law. It is also used in other Commonwealth common law jurisdictions, sometimes with suitable modifications to the phrase as an aid to local comprehension. The route of the original “Clapham omnibus” is unknown but London Buses route 88 was briefly branded as “the Clapham Omnibus” in the 1990s and is sometimes associated with the term
Many comments have been made by politicians from both sides of the Brexit argument about the whys and wherefores of leaving and remaining. One thing these politicians have in common is their arrogant assumption is that they know how their voters think and why.
Well for their education here is one cri de coeur from a member of the public whose identity will not be revealed by this organ as this would rob him of the privileged status of anonymity.
“………………I can and will only speak for myself. I will not try to speak for the other 17.4 million that voted with me or the 15 odd million that voted against me as others will. My reason as a married father of six children is the following:-
Globalisation and its effect on our environment, economy and every ounce of our day to day living. The effect of shear want and waste from an economic and environmental stance. Management failures in many businesses on a monumental scale. Politicians living on Easy Street not being held to account (like our management within business). Corrupt people in power again living a totally different life to those they are supposed to represent. An 11% pay rise as a reward for fiddling their expenses; while those hard up in society are having benefits cut because of the politicians failings and the failings of bankers which went deliberately unnoticed by our politicians.
NOT ONE OF THESE PEOPLE HAVE EVER BEEN HELD TO ACCOUNT.
As always it was us. The little guy just left to pick up the pieces of these people who have proven to be totally inadequate at best, totally untouchable at worst. If this was the 30s at least the bankers would have had the decency to realise the depths of they’re depravity and throw themselves out of the window. Then after all this you ask me to vote in favour of another layer of quangos, with no democratic account, pursuing 1940s agenda and pushing forward toward Russia’s sovereign soil asking me to work harder pay more taxes so that we can form a European army…
Is there any wonder when a man like Mr Farrage speaks in layman terms instead if spin that I decided in favour of his policy?
I like the 17.4 million (I’m guessing) are to coin a phrase “pi55ed off”, with bull**** or as the politicians call it “spin”.
It’s proven to be a failure and I am glad we are getting out before it implodes and we have even more debt added to our financial problems.
As I have said this is my point of view and I am not wishing for an argument. I am simply making a statement of MY fact nobody else’s. Here’s to the democratic accountability of this great island of ours………………”
Well said fellow Brexiteer.
Ref. the corrupt bankers Iceland managed to hold those responsible in their country for the financial crash by imprisoning the lot of them, while our craven government made us all BAIL OUT the crooks here!
And they were astonished we dared to vote to leave the even more corrupt EU?
As Corporal Jones used to say, “They don’t like it up ’em”.
